1. Introduction

Welcome to ClayHub NZ.

ClayHub NZ ("ClayHub", "the Platform", "we", "us" or "our") is a New Zealand-based digital platform developed to simplify the management and administration of clay target shooting.

The Platform supports shooting clubs, individual shooters, competition organisers and authorised sporting administrators.

ClayHub NZ is independently owned and operated by Doug Bodley. It is not owned or operated by Waikato Clay Target Club or the New Zealand Clay Target Association (NZCTA).

These Terms of Service ("Terms") govern access to and use of ClayHub.

By registering for an account, accessing the Platform or using its services, you agree to comply with these Terms. Where a user is unable to enter into an agreement independently, appropriate parental, guardian or other lawful authorisation may be required.

If you do not agree to these Terms, you should not register for or use the Platform.

2. Purpose of ClayHub

ClayHub is designed to support the administration of clay target shooting activities.

Depending on the features available, the Platform may provide:

  • Shooter registration and profile management.
  • Club membership and affiliation records.
  • Competition nominations and entry management.
  • Competition administration and scoring.
  • Publication of competition results and rankings.
  • Shooting grades, classifications and handicap records.
  • Historical shooting results and achievements.
  • Club administration tools.
  • Communication and reporting features.
  • Integration with Facebook and other third-party services.

Features may be added, modified or removed as the Platform develops.

ClayHub is an independent technology platform. Use of ClayHub does not, by itself, establish membership of any shooting club or national sporting organisation.

3. User Registration and Accounts

Users may be required to create an account to access certain features.

When registering, users agree to:

  • Provide accurate and reasonably current information.
  • Maintain the confidentiality of their account credentials.
  • Use their account only for authorised purposes.
  • Not impersonate another person.
  • Notify ClayHub if they suspect unauthorised account access.
  • Update relevant information when circumstances change.

Users are responsible for activity conducted through their accounts to the extent permitted by law.

ClayHub may suspend or restrict accounts where reasonably necessary to protect the Platform, other users or the integrity of sporting records.

4. Shooter Profiles and Personal Information

ClayHub may maintain information about individual shooters, including:

  • Names and club affiliations.
  • Contact details and dates of birth.
  • Grades and classifications.
  • Handicap information.
  • Competition nominations and participation.
  • Competition scores and results.
  • Historical competition records.

Personal information will be handled in accordance with the ClayHub NZ Privacy Policy and applicable New Zealand law.

Private information, including residential addresses, personal contact details and full dates of birth, will not normally be publicly displayed.

The Privacy Policy is available at:

https://wctcclubmanager.base44.app/privacy

5. Public Competition Information

Clay target shooting relies on accurate and accessible sporting records.

ClayHub may publish information normally associated with participation in organised clay target shooting competitions.

This may include:

  • Shooter names.
  • Affiliated clubs.
  • Grades and classifications.
  • Handicap information.
  • Competition entries and participation.
  • Scores, rankings and competition results.
  • Historical sporting achievements.

Public competition information may be accessible to users without a ClayHub account.

Users acknowledge that competition information may form part of an ongoing sporting record and may remain available after an individual stops using the Platform, subject to applicable privacy rights and lawful retention requirements.

ClayHub will consider requests to correct, restrict or remove information in accordance with its Privacy Policy and applicable law.

6. Junior Shooters

ClayHub supports participation by junior clay target shooters.

Junior competition results may be included in publicly available sporting records where publication is appropriate and consistent with relevant privacy requirements.

Junior shooters' residential addresses, personal email addresses, telephone numbers and full dates of birth will not be displayed in public shooter profiles.

Appropriate care will be taken when collecting, managing and disclosing information relating to junior shooters.

Parents or guardians may assist with registration and account administration where appropriate, taking account of the junior shooter's age, maturity, circumstances and legal rights.

Concerns about the publication of junior information may be raised with ClayHub at doug@bodley.co.nz.

7. Club Administrators and Authorised Users

ClayHub may provide additional functions to authorised club administrators, competition officials and sporting organisations.

These users must:

  • Access personal information only for legitimate administrative purposes.
  • Maintain appropriate confidentiality.
  • Protect private shooter and membership information.
  • Enter and update records accurately.
  • Respect the rights of shooters and other users.
  • Not disclose private information without appropriate authority.
  • Not misuse administrator access or attempt to bypass system permissions.

Administrative access does not provide unrestricted rights to view, modify or distribute information held within ClayHub.

Users granted administrative permissions are responsible for using those permissions appropriately.

ClayHub may restrict or withdraw administrative access where reasonably necessary to protect information or platform integrity.

8. Competition Results, Grades and Handicaps

Competition organisers and authorised officials are responsible for providing accurate results and records.

ClayHub provides technology for recording, processing and displaying this information.

Official competition rules, eligibility requirements and handicap procedures remain the responsibility of the relevant club, competition organiser or authorised governing body.

Where a result, grade or handicap is disputed, users should raise the matter with the relevant organiser or administrator.

ClayHub may require confirmation from the appropriate authority before changing an official sporting record.

ClayHub does not guarantee that all information supplied by third parties is error-free.

Where ClayHub calculates or displays grades or handicaps, the applicable rules and approved calculation methods must be used before those outputs are treated as official.

9. Historical Sporting Records

ClayHub recognises that historical competition information is important for the integrity of sporting records.

Historical results, scores, grades and handicap records may be retained where there is a legitimate and lawful reason for doing so.

Deleting a user account does not automatically delete all historical sporting records associated with that user.

Where appropriate, unnecessary personal information may be removed or identifying details reduced while retaining valid sporting results.

Requests concerning historical records will be considered individually under the Privacy Policy and applicable law.

10. Competition Entries and Payments

ClayHub may facilitate competition nominations and registrations.

Competition entry fees and other payments are currently handled outside ClayHub by the relevant shooting club or event organiser.

ClayHub does not currently process payment card transactions or hold payment card information.

Payment arrangements, entry fees, refunds and competition cancellation terms are the responsibility of the relevant organiser unless expressly stated otherwise.

ClayHub is not responsible for payment disputes between shooters and clubs where ClayHub is not the contracting or payment-processing party.

Any future payment functionality will be subject to updated terms and relevant disclosures.

11. Facebook and Third-Party Integrations

ClayHub may integrate with Facebook and other third-party platforms to support the publication of competition news, event information, results and other authorised content.

Users connecting third-party accounts must have the appropriate authority to do so.

For example, users connecting a Facebook Page must have sufficient permissions to manage the Page and authorise the relevant integration.

ClayHub will only request permissions reasonably necessary for the available integration features.

Content published through Facebook or another external service may also be subject to that service's terms, policies and restrictions.

Users may revoke access to connected services through the relevant provider's account settings.

ClayHub is not responsible for outages, service changes or restrictions imposed independently by third-party providers, except where applicable law provides otherwise.

12. Acceptable Use

Users must not:

  • Access accounts or information without authorisation.
  • Misuse private shooter or club information.
  • Enter deliberately false competition results.
  • Manipulate grades, handicaps or rankings.
  • Impersonate another shooter, club official or administrator.
  • Harass, threaten or abuse other users.
  • Upload malicious software or harmful content.
  • Attempt to interfere with application security.
  • Use ClayHub for unlawful activities.
  • Commercially exploit private personal information obtained through the Platform without appropriate authority.

ClayHub may investigate suspected misuse and take proportionate action, including restricting access or suspending accounts.

13. Information Supplied by Clubs and Organisations

Participating clubs and sporting organisations are responsible for ensuring information they provide to ClayHub is accurate and is supplied for lawful purposes.

Organisations must provide appropriate privacy notices and obtain any authorisations required for the collection, sharing or publication of personal information.

ClayHub may rely on information supplied by authorised club officials, but may request supporting verification where reasonably necessary.

Participation by a club or organisation does not automatically create a formal affiliation, endorsement or agency relationship with ClayHub.

14. Intellectual Property

The ClayHub name, original application design, software functionality and other original platform materials are owned by the Platform operator or used under applicable licences.

Users and participating organisations retain ownership of material they are legally entitled to own.

By uploading or submitting content, users grant ClayHub a non-exclusive permission to host, reproduce, process, display and distribute that content as reasonably necessary to provide the authorised services.

Users must ensure they have the appropriate rights to submit content to the Platform.

Nothing in these Terms transfers ownership of a user's personal information to ClayHub.

15. Platform Availability and Changes

ClayHub is an evolving application.

We aim to provide a reliable and useful service but cannot guarantee uninterrupted availability.

The Platform may occasionally be unavailable due to maintenance, updates, technical problems or third-party service interruptions.

Features may be modified, replaced or discontinued.

Where a significant change materially affects users or participating organisations, reasonable notice will be provided where practicable.

16. Account Suspension and Termination

Users may request closure of their accounts by contacting ClayHub.

ClayHub may suspend, restrict or terminate access where reasonably necessary because of:

  • Serious or repeated breaches of these Terms.
  • Misuse of personal information.
  • Unauthorised access or security risks.
  • Deliberate manipulation of competition records.
  • Unlawful activity.
  • Other conduct materially affecting the security or integrity of the Platform.

Where appropriate, users will be informed of the reason for restrictions and given an opportunity to raise concerns.

Account closure and data deletion will be handled in accordance with the Privacy Policy and Data Deletion Instructions.

17. Liability and Legal Rights

ClayHub aims to provide accurate, reliable and secure services.

However, the Platform relies partly on information supplied by clubs, competition organisers and authorised users.

To the extent permitted by law, ClayHub does not accept responsibility for losses arising solely from inaccurate third-party records, unauthorised use by others or service interruptions outside its reasonable control.

Nothing in these Terms excludes, restricts or modifies rights, guarantees, remedies or obligations that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 and Privacy Act 2020.

Any exclusion or limitation of liability applies only to the extent permitted by New Zealand law.

18. Privacy and Data Protection

The collection, use, storage, sharing, correction and deletion of personal information is governed by the ClayHub NZ Privacy Policy.

Users are encouraged to review that policy before registering or supplying personal information.

Privacy enquiries may be directed to:

doug@bodley.co.nz

19. Complaints and Disputes

Users should first contact ClayHub if they have concerns about the Platform or its operation.

We will make reasonable efforts to consider and resolve complaints fairly.

Competition-specific disputes should ordinarily be directed to the responsible competition organiser or sporting authority.

Privacy complaints may also be raised with the Office of the Privacy Commissioner.

20. Changes to These Terms

ClayHub may update these Terms as the Platform evolves.

The current version will be made available through the ClayHub website.

Where material changes affect users' rights or obligations, reasonable notice will be provided and additional agreement sought where legally required.

Continued use after valid notice of applicable updated Terms may constitute acceptance where permitted by law.

21. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes relating to these Terms will be subject to the jurisdiction of the New Zealand courts, subject to applicable statutory rights and jurisdictional requirements.
